Ontario Yellow Commerical Truck Sticker for H1s?

Guys,



Need you legal brains here, we have had a member stopped and informed that he requires a yellow Commercial vehicle truck sticker on his H1 because it is over 10,000lbs. These are the stickers that cost you an extra $70+ a year and require you to have a safety done every year. Does anyone know anything about this out there?? What is the true law and does it truly apply to Hummers? We need the info fast so if anyone has any... please....this could impact a lot of owners if a precedent is set here.



Let us know because one of our members got a $300 fine when he didn't have one on his truck





I will post a photo of what they look like in case you are not sure what I am referring to.

The Hummer H1 is NOT a Truck, the DMV made this very clear to me when I was getting my licenses for it. If it were it would have black lettering on the license plate. The DMV told me that it is an SUV and just goes under regular passenger vehicle licensing, if it where a truck it would have black lettering on the plate and then would be subject to commercial vehicle laws. There are two types of commercial trucks, under 3,000kg and over 3,000kg. Personal use commercial trucks are under 3,000kg. But like I said, when you register your Hummer they should put it under SUV and give you a Blue lettered license plate. I dont know if that helps at all, I would be taking that ticket to court.

Thanks Tyler, this is exactly what he is planning on doing, taking it to court, just trying to find some concrete facts or documents that state it, not sure how the courts work on this one.

If its an H1 wagon, I would really be pushing the SUV aspect. If a commercial truck is anything over 3,000kg, than what about a suburban or other large SUV??

I think he should be able to get out of the ticket. ultimately if it is not used for commercial use you should be fine (no company logos on the truck). I see vans out there that have Black license plates and i also see Vans that have Blue license plates. The black plates always belong to the vehicles that are used commercially, like a Rogers or Bell Van, but not your family Van.

Was the cop having a really bad day or something??? HA HA

Maybe it was the same guy from the Mini get together!

This is the info I found on the licensing. It is not very clear so I would still push the SUV if his license plate is blue.

Look up the meaning of a commercial vehicle!!



. Ontario traffic act states:



1. (1) In section 107 of the Act and in this Regulation,



“commercial motor vehicle” includes a school purposes vehicle but does not include,

....





(g) a pick-up truck that,



(i) is being used for personal purposes without compensation, and



(ii) is not carrying, or towing a trailer that is carrying, commercial cargo or tools or equipment of a type normally used for commercial purposes, or

I have drove for purolator courier certain trucks can be driven with glass g licecinse... the truck i drove was 3 ton that looks like a 5 ton but had hydrolic brakes 5 speed transmission... i had been pulled over asked for drivers licecinse by the o.p.p.they where going to charge me for driving a 5 ton which you need d.z. but they found out after they ran the plate bingo 3 ton .... had to show them c.v.o.r. and log book a.k.a. post pretrip book which i go over the truck checking stuff off one is to check the yellow sticker for correct date ... if expired truck has to go for check up

Kevin forgot we had that is his brother had an 1976 E150 window van which was commercial before he bought it used the transfer was sticky but it was replated with blue passenger plates.
